1. Overview

This website (the "Site") is operated by Card Imports, a Wyoming limited liability company with operations and shipping in Texas. Throughout the Site, the terms "we," "us," and "our" refer to Card Imports. By visiting cardimports.com, accessing any part of the Site, or purchasing any product, you ("you," "the user," "the buyer") agree to be bound by these Terms of Service ("Terms"), our Refund Policy, our Shipping Policy, and our Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree to all of the foregoing, do not use the Site or place an order. These Terms apply to all users, including visitors, customers, vendors, and contributors of content.

2. AS-IS Sale, All Sales Final

All product sold by Card Imports is sold AS-IS, WITH ALL FAULTS, and all sales are final. Except for the limited authenticity guarantee described in Section 7 and our Refund Policy, Card Imports makes no warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. There is no right of return, refund, replacement, or exchange. Any accommodation provided by Card Imports is at our sole and absolute discretion and, when offered, is issued only as non-transferable store credit redeemable at cardimports.com. Cash refunds, refunds to the original payment method, and exchanges are not provided as remedies under any circumstances, except where (a) an order is cancelled by Card Imports before tender to the carrier, or (b) non-waivable consumer-protection law in your jurisdiction requires otherwise and only to the minimum extent so required.

3. Delivery Not Guaranteed; Risk of Loss

Card Imports does not guarantee delivery dates, transit times, or successful delivery for any order. Title and risk of loss pass to the buyer the moment the package is tendered to the carrier. From that moment forward, the package is the buyer's property and the carrier's responsibility. See the Shipping Policy, including the untracked-shipping waiver in Section 4 of that policy, incorporated here by reference.

4. Returns and Accommodations

Returns and accommodations are governed exclusively by our Refund Policy, incorporated by reference. Any accommodation under that policy is at Card Imports' sole and absolute discretion, and any accommodation offered is issued only as non-transferable store credit. Untracked shipments and tracked shipments without signature confirmation are not eligible for any remedy from Card Imports on non-receipt cases; the buyer's recourse is against the carrier.

5. Sales Tax

Card Imports collects sales tax in jurisdictions where required by law, including Texas (where we have physical operations) and any other state where we meet economic-nexus thresholds. Applicable tax is calculated at checkout based on the shipping address.

6. Eligibility, Identity, and Age Verification

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction (whichever is greater), to place an order. By using the Site you represent that you meet this requirement, that all information you provide is accurate, current, and complete, that you are the authorized holder of any payment method used, and that you have the legal capacity to enter into a binding contract. The Site is intended for adult purchasers only and is not directed to anyone under eighteen. Card Imports may at our sole and absolute discretion require identity, age, address, or cardholder verification before accepting, processing, or shipping any order, and may cancel any order where reasonable verification cannot be completed. We may use third-party verification services for these purposes.

7. Products and Limited Authenticity Guarantee

Card Imports sells only authentic, sealed, factory-condition Pokémon Trading Card Game (TCG) products sourced from international markets, including but not limited to Japan, Korea, Indonesia, Taiwan, Vietnam, and Thailand. The single express warranty Card Imports makes is the limited authenticity guarantee set out in the Refund Policy. Any accommodation under that guarantee is, when offered, issued only as non-transferable store credit, at Card Imports' sole and absolute discretion. Product images, descriptions, and condition notes are otherwise provided in good faith. Photography lighting, manufacturing-batch variation, regional print differences, surface scuffs, foil wear, sealed-product weight, internal contents distribution, pull rates, and other condition variance inherent to sealed import product are not defects and are not a basis for any remedy.

8. Trademark and Reseller Disclaimer

Pokémon, the Pokémon TCG, Pokémon Trading Card Game, and all related names, characters, logos, designs, marks, and trademarks are the exclusive property of Nintendo, The Pokémon Company International, GAME FREAK, and Creatures Inc. Card Imports is an independent reseller of authentic factory-sealed product and is not affiliated with, endorsed by, licensed by, sponsored by, or in any way connected to Nintendo, The Pokémon Company International, GAME FREAK, Creatures Inc., or any of their subsidiaries or affiliates. All trademarks are used solely nominatively to identify the authentic product being resold. Nothing on this Site shall be construed as granting any license or right to use any trademark without the prior written consent of the trademark owner.

9. Pricing, Payment, Promotional Codes, and Order Acceptance

All prices are listed in US Dollars and are subject to change without notice. Promotional pricing may have stock, geographic, or time limits. Promotional codes, discount codes, store credits, and similar offers are issued by Card Imports for personal, non-commercial use only; are non-transferable; may not be combined unless expressly permitted; may not be sold, resold, traded, or redeemed for cash; expire on the date stated by Card Imports or at our discretion if no date is stated; and may be modified or revoked at any time. Any use of a code in violation of these Terms (including without limitation use of an expired code, use beyond stated limits, stacking codes that are not stackable, fraudulent generation of codes, or use of a code obtained through unauthorized means) is grounds for order cancellation, forfeiture of the code, and at Card Imports' discretion suspension or banning of the buyer. We reserve the right to refuse, modify, or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, pricing or stock errors, sanctioned-destination orders, abuse of promotional codes, suspected reseller-bot activity, or buyers with a history of payment disputes against us. Orders cancelled by Card Imports before tender to the carrier are refunded in full to the original payment method. This cancellation refund is not a remedy under the Refund Policy and does not modify the AS-IS, store-credit-only character of any post-shipment accommodation.

10. Pre-Contact and Dispute Resolution Process

If you have any issue with an order, you must contact support@cardimports.com with your order number and a description of the issue, and you must allow Card Imports a reasonable opportunity to evaluate and respond, before initiating any chargeback or other third-party dispute. Contacting us first is a material term of these Terms. Allowing Card Imports a reasonable opportunity to respond is required so we can gather any documentation we may need, review the order, and consider whether to provide a discretionary accommodation. By placing an order you authorize Card Imports to provide any relevant transaction records to your card issuer and any payment processor in connection with any subsequent dispute, including without limitation order history, IP address, checkout log, terms-of-service acceptance record, carrier tracking, delivery scans, signature confirmation, the shipping waiver where applicable, and these Terms to which you agreed at checkout.

11. Chargeback Policy

Filing a chargeback or other payment-dispute claim with your card issuer or payment provider before contacting Card Imports and allowing a reasonable opportunity to respond is a material breach of these Terms. Without limiting any other remedy:

(a) Card Imports will defend representment with the full transaction record described in Section 10, including these Terms and the Refund Policy to which you agreed at checkout.

(b) Buyers who file chargebacks in violation of this Section may be permanently banned from cardimports.com, may have their information reported to merchant fraud-prevention databases, and may be subject to recovery of all reasonable costs incurred in connection with the dispute, including chargeback fees, representment costs, and reasonable attorneys' fees.

(c) Untracked shipments and tracked shipments without signature confirmation are subject to the waivers in our Refund Policy and Shipping Policy, and a chargeback contradicting those waivers is filed at the buyer's risk.

(d) Confirmed authenticity issues are governed exclusively by the Limited Authenticity Guarantee in the Refund Policy, which provides for non-transferable store credit at Card Imports' sole and absolute discretion only.

12. Binding Arbitration and Class-Action Waiver

READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

(a) Any dispute, claim, or controversy arising out of or related to these Terms, the Site, your use of the Site, or any product purchased from Card Imports, including any question regarding the existence, validity, or termination of these Terms (a "Dispute"), shall be resolved exclusively by binding individual arbitration, except as expressly stated in subsection (d) below.

(b) The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator. The seat of the arbitration shall be Cheyenne, Wyoming, unless the AAA determines that a different location is required by its rules. The arbitrator's award is final and binding and may be entered in any court of competent jurisdiction.

(c) YOU AND CARD IMPORTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person, may not preside over any form of representative or class proceeding, and may award relief only to the individual party seeking it and only to the extent necessary to provide relief warranted by that party's individual claim.

(d) Notwithstanding subsection (a), either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction in Wyoming for the protection of intellectual property, trade secrets, or confidential information.

(e) You may opt out of this Section 12 by sending written notice of your decision to opt out to support@cardimports.com within thirty (30) days of your first purchase. Your opt-out notice must include your full name, the order number of your first purchase, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.

13. Acceptable Use; Order Limits; Anti-Bot

You agree to use the Site only for lawful purposes. You will not:

(a) Use the Site to violate any law, regulation, or third-party right.

(b) Attempt to circumvent purchase limits, promotional restrictions, anti-fraud controls, IP-address restrictions, or rate limits.

(c) Use any robot, spider, scraper, automated script, bot, headless browser, sniping tool, or other automated means to access the Site, monitor inventory, query pricing, or place orders, without our express written permission.

(d) Place orders using multiple accounts, multiple email addresses, multiple payment methods, or multiple shipping addresses for the purpose of evading per-customer or per-household quantity limits.

(e) Resell our product under a representation that you are the original manufacturer, that the product is licensed by Nintendo, The Pokémon Company, or any affiliated entity, or that the product is anything other than what Card Imports represents it to be.

(f) Use the Site to transmit malware, spam, or content that infringes any third-party right.

(g) Use the Site to defraud Card Imports, including without limitation by filing a chargeback in breach of Sections 10 and 11, by misrepresenting the contents of a delivered shipment, by submitting a false authenticity claim, or by claiming non-receipt of a shipment that the carrier confirms was delivered.

Card Imports may impose quantity limits per item, per order, per customer, per household, per payment method, per IP address, and per shipping address, and may modify these limits at any time without notice. We may cancel any order that exceeds these limits without entitlement to any remedy beyond a refund of the original payment for any cancelled portion. Any breach of this Section may result in immediate suspension or permanent banning from cardimports.com, forfeiture of any pending order, reporting to fraud-prevention databases, and any other remedy available at law or in equity.

14. Intellectual Property and User-Generated Content

All Site content, including text, graphics, logos, photography, page layouts, product images, and software, is the property of Card Imports or its licensors and is protected by United States and international intellectual property laws. You may not copy, reproduce, modify, distribute, scrape, mirror, or create derivative works of any Site content without our prior written consent. If you submit any review, rating, comment, photograph, video, or other content to the Site or to Card Imports (collectively, "User Content"), you represent that you own or have all rights necessary to grant the license below, and you grant Card Imports a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and create derivative works of the User Content in any media now known or later developed, for any purpose, including marketing and advertising, without compensation to you. You also waive any moral rights in the User Content to the maximum extent permitted by law. You will not submit User Content that is false, misleading, defamatory, infringing, obscene, harassing, or otherwise unlawful. Card Imports may remove any User Content at our sole discretion at any time.

15. Account Information

If you create an account, you are responsible for the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@cardimports.com if you suspect unauthorized access.

16. Disclaimers

The Site and all products are provided "as is" and "as available." To the maximum extent permitted by law, and except for the limited authenticity guarantee referenced in Section 7, Card Imports disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected. We make no representation about the cards inside any sealed product, the internal contents distribution of sealed product, sealed-product weight, grading outcomes of cards pulled, pull rates, or the resale or secondary-market value of pulled or sealed product.

17. Limitation of Liability

To the maximum extent permitted by law, Card Imports, its officers, directors, employees, members, managers, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation loss of profits, loss of resale value, loss of grading opportunity, loss of data, loss of goodwill, or other intangible losses arising out of or related to your use of the Site or any product purchased from us. Our total aggregate liability for any claim arising out of or related to these Terms, the Site, or any product shall not exceed the amount you paid for the product giving rise to the claim, less any shipping, handling, processing, payment-processor, or tax amounts.

18. Indemnification

You agree to indemnify, defend, and hold harmless Card Imports and its officers, directors, employees, members, managers, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your violation of any law or third-party right, (c) your misuse of any product purchased from us, (d) any third-party dispute or chargeback you initiate in breach of Sections 10 or 11, or (e) any inaccurate information you provide at checkout, including without limitation an incorrect shipping address.

19. Force Majeure

Card Imports is not liable for any failure, delay, or non-delivery caused by events outside our reasonable control, including carrier disruptions, customs holds, weather, labor actions, acts of God, government actions, pandemics, or war.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Subject to Section 12 (Binding Arbitration and Class-Action Waiver), any judicial proceeding permitted by these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

21. Statutory Rights

Nothing in these Terms limits any non-waivable statutory consumer right that applies to your jurisdiction. Where local law grants a buyer a right that cannot be waived by contract, that right is preserved to the minimum extent the law requires. Otherwise, all provisions above apply in full.

22. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions, including without limitation the AS-IS basis of sale, the limitation of liability, the arbitration clause, and the class-action waiver, will continue in full force and effect.

23. Entire Agreement

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Card Imports regarding the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

24. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
